By accessing or using SMTP INFRA ("Service"), you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you may not access the Service.

2. Description of Service

SMTP INFRA provides enterprise SMTP infrastructure services, including server management, IP reputation monitoring, email warm-up, campaign sending, and analytics. We reserve the right to modify or discontinue the Service at any time with reasonable notice.

3. Account Responsibilities

You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Ensuring your use complies with applicable laws and regulations
  • Providing accurate and complete registration information

4. Acceptable Use

You agree not to use the Service to:

  • Send unsolicited bulk email (spam)
  • Violate CAN-SPAM, GDPR, or other applicable laws
  • Transmit malware, viruses, or other malicious code
  • Harvest email addresses or personal data
  • Engage in phishing, fraud, or deceptive practices
  • Interfere with or disrupt the Service

5. Email Compliance

You must comply with all applicable email regulations, including obtaining proper consent from recipients, providing clear unsubscribe mechanisms, and accurately identifying yourself as the sender. We may suspend accounts that violate email best practices or generate excessive complaints.

6. Payment Terms

Subscription fees are billed in advance on a monthly or annual basis. All fees are non-refundable except as required by law. We may change pricing with 30 days notice. Failure to pay may result in service suspension.

7. Intellectual Property

The Service and its original content, features, and functionality are owned by SMTP INFRA and are protected by copyright, trademark, and other intellectual property laws. You retain ownership of content you transmit through the Service.

8. Limitation of Liability

To the maximum extent permitted by law, SMTP INFRA shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of the Service. Our total liability shall not exceed the fees paid in the twelve months preceding the claim.

9. Service Level Agreement

We strive for 99.9% uptime availability. In the event of downtime exceeding this threshold, eligible customers may receive service credits as outlined in our SLA documentation.

10. Termination

We may terminate or suspend your account immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. You may terminate your account at any time by contacting support.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of significant changes by email or through the Service. Continued use of the Service after changes constitutes acceptance of the new Terms.
